About the H-2A Program

The H-2A temporary agricultural program allows agricultural employers who anticipate a shortage of domestic workers to bring nonimmigrant foreign workers to the U.S. to perform agricultural labor or services of a temporary or seasonal nature. Employment is of a seasonal nature when it is tied to a certain time of year by an event or pattern, such as crop growing cycles and/or livestock production, and requires labor levels above what is necessary for ongoing operations. Employment is of a temporary nature when the employer’s need to fill the position with a temporary worker will last no longer than 9 months. At the end of their work contract the workers return home for a minimum of 3 months, at which time we file to return them for the following season.

You will need to establish your “dates of need” in order to determine exactly when to file. Your application will be submitted between 75 and 60 days. However, our experience has proven it takes longer than 75 days to bring workers, so we suggest you contact us at least 3 months prior to your “date of need”.

Peak Season Agriculture has streamlined the application and recruiting process which will make your hiring process easier and cost-effective. We do not have a membership fee. We will provide you with a quote based on the number of workers and the types of positions you would like to fill. There is a one-time annual application filing fee, and recruitment fee (if required). Our annual fee includes overseeing your certification, recruitment activity, and guidance to help you keep current and in compliance.
Additional out-of-pocket filing fees include a $110.00 US-DOL fee (plus $10.00 per additional worker) and the USCIS fee of $460.00.
